Shocking that a Bissinger piece would begin with "I don't like".
I almost have sympathy. But I like to think I would be equally upset about all perjurers beyond Barry as well. If you've ever sat on a jury for a case, you'd hear the judge instruct you that witness testimony IS evidence in our system. Assuming you believe the witness, that is. Think about that for a second. I was on a trial that centered around a rape. Essentially, if we believed the victim who testified, that was to be treated as just as solid evidence as something like a DNA test.
Our judicial system HEAVILY relies on the belief (or hope, I should say) that people on the stand tell the truth. So I believe there should be very harsh penalties for those who violate this. And I believe Barry did lie, knowingly, on the stand, in a childish attempt to weasel out of what would likely have been far lesser crimes than perjury.
Belief is nice, but the law states it has to be beyond a reasonable doubt, and the questions asked by the prosecutors were vague enough that Bonds probably will not be covicted.
The conduct of Jeff Novitzsky in circumventing the law to get the CDT/Quest files and exceed the scope of his warrant ticked off Judhe Susan Ilston, who will be the judge on the case next March.
And many of the charges invovle the use of THG (the clear), which was not declared a schedule III substance by the FDA until October 2003. So did Bonds get charged with numerous charges of perjury for taking what was a legal substance at the time and using the cream to mask a legal drug?
